Substantial Compliance
Definition: The level of compliance with federal requirements in which any identified noncompliance poses no greater risk to resident health or safety than the potential for causing minimal harm. Achieving substantial compliance removes enforcement remedies.
In Practice
A facility reaches substantial compliance when all cited deficiencies have been corrected and verified by the survey agency, or when remaining deficiencies are at severity levels A-C only. The date of substantial compliance is important because it determines when CMPs and other sanctions are removed.
