Resident Rights
Definition: The comprehensive set of rights guaranteed to every nursing home resident under federal law, including the right to dignity, self-determination, privacy, communication, visitation, grievances, and freedom from abuse and restraints.
In Practice
Resident rights are codified in 42 CFR §483.10-§483.12 and covered by F-Tags F0550 through F0609. Violations of resident rights can result in serious enforcement actions, particularly those involving abuse, neglect, or misappropriation of property. Surveyors assess resident rights compliance through interviews, observations, and record reviews.
