Enforcement Remedies
Definition: The range of sanctions CMS can impose on nursing homes found to be out of compliance with federal requirements. Remedies include CMPs, DPNA, state monitoring, directed POCs, temporary management, and termination.
In Practice
CMS selects enforcement remedies based on the scope and severity of deficiencies, the facility's compliance history, and whether the facility poses an immediate risk to residents. Multiple remedies can be imposed simultaneously. The goal is to achieve compliance as quickly as possible.
